Supreme Court Considers Child Support Case

The State Supreme Court is considering whether a man should be jailed for refusing to pay child support for a child that is not his. The case involves David Salazar, who was jailed for a month for failing to pay child support.

There is no disagreement that he is not the biological father of the child, who was conceived and born while he and his wife were separated but not yet divorced. Present law lets a court order men to pay child support even though the man is not the biological father.
