A special prosecutor says no charges will be filed against a Missouri trooper in connection with the drowning death of an Iowa man at the Lake of the Ozarks in May.

The Kansas City Star reports Special Prosecutor Amanda Grellner agreed with a coroner’s jury that the drowning was an accident.

31-year-old Brandon Ellingson was handcuffed and being transported to shore, under arrest for suspicion of drunk boating, when he fell out of the State Patrol’s boat. The life jacket that had been put down over his arms slipped off and Ellingson sank to the bottom of the Lake.

Highway Patrol Superintendent Ronald Replogle has issued a statement saying the Patrol, “will continue the review of all procedures related to this incident.”
