Missouri voters head to the polls Tuesday to decide a property tax question tied to Senate Bill 3, which appears on ballots in 97 of the state’s 114 counties.
The measure asks whether future property taxes on owner‑occupied homes should be frozen or capped, depending on how each county is classified under the law.
However, the vote is taking place as more than 40 Missouri counties are suing the state, arguing Senate Bill 3 is unconstitutional because it applies unevenly across counties. The lawsuit has not been resolved, and a court ruling is not expected before Election Day.
Missouri Association of Counties Executive Director Steve Hobbs said counties were required to hold an election that could ultimately be invalidated if courts side with the plaintiffs.
“If a judge finds the law unconstitutional, the election itself could later be thrown out,” Hobbs has said.
Despite the legal uncertainty, counties were still required to place the question on the ballot. Hobbs said the cost of holding the election for counties involved in the lawsuit is estimated to range from $10,000 to $40,000 each.
Polls statewide are open Tuesday from 6 a.m. to 7 p.m.
