The state is reviewing whether to discipline a northeast Missouri sheriff’s peace officer license.

Online court records show the Missouri Department of Public Safety is seeking circuit court records involving a mistrial this year in the case of Scotland County Sheriff Bryan Whitney. His trial centered around a state trooper arresting Whitney in 2023 for drunk driving allegations.

The Scotland County Circuit Court mistrial occurred after the trooper said a breathalyzer test showed Whitney was over the legal limit, despite those results not being allowed in court.

The Department of Public Safety is seeking evidence to decide whether to file a complaint with the Missouri Attorney General’s Office to discipline Whitney’s peace officer certification. Discipline could range from probation, suspension, or permanent revocation of his peace officer’s license.

The department says if his peace officer license is revoked or surrendered, he cannot work as a peace officer again. A suspended license means he cannot work as a peace officer until the period of suspension ends. If his license is on probation, he can work as a peace officer.

A new jury trial in his drunk driving case has been scheduled for February 2026.
