Missouri can proceed with its lawsuit against China, but only on one count.
A lower federal court tossed out the suit in 2022. However, on Wednesday the 8th U.S. Circuit Court of Appeals in St. Louis ruled that Missouri can sue the communist country over allegations of hoarding protective gear, including masks. The original suit blamed China for the COVID-19 pandemic and claimed it did little to nothing to keep the virus from spreading to Missouri and the rest of the world.
Attorney General Andrew Bailey issued the following statement: “We will continue to fight for accountability for the horror communist China unleashed on Americans in the form of COVID-19. We are headed back to court to pursue remedies for all Missourians. I’m proud of this win on behalf of the American people.”
