A man who served 10 years in prison for molesting a 7-year-old girl has won his freedom from being indefinitely committed as a sexually violent predator.

The St. Louis Post-Dispatch reports Macon Baker has been in custody since he finished that sentence in 2006 and has gone through three previous trials to determine whether he should be held in the Sex Offender Rehabilitation and Treatment Services (SORTS) program, from which only three people have been granted strict conditional release since 1999.  Those trials ended in hung juries.

A jury on Friday decided he is not “more likely than not” to commit future sexual violence if set free.

Baker was also convicted in 1983 of molesting a 5-year-old girl.
