A Cole Co. judge has ordered the Attorney General’s Office to prepare to explain why the state, namely Gov. Jay Nixon, has not set a date for a special election to fill four seats in the legislature that are currently vacant.

The case has been brought against Nixon by a group of residents, who say more than 300,000 Missourians are not being represented in state government.

Judge Dan Green has granted a motion by the plaintiffs to expedite the process, and has ordered Nixon’s counsel, the Attorney General, to respond to the show cause order by Tuesday, Feb. 4. Green has also ordered the plaintiffs to reply to that response by the end of the day Thursday, Feb. 6. Green’s order says the court will hold a hearing on the issue on or before Friday, Feb. 7.
