The Clay County prosecutor is seeking a court order to exhume remains from a Kearney cemetery to see if they really belong to a 19th century outlaw that road with Jesse James and Cole Younger.

Clell Miller was shot to death in a failed bank robbery in Minnesota in 1876. What happened to his remains has been debated since the medical student that killed him had him dug up and used him in an anatomy class in Michigan.

Researchers hope to compare DNA from the remains in the grave to Miller’s modern-day relatives.
