He could be back in Arizona next week for a hearing, but prosecutors want the suspect in the January shooting that killed six and wounded 13 to spend eight more months in a Missouri federal prison for mental health treatment.

Lawyers for Jared Loughner want a federal court to deny the extension. They say prosecutors haven’t proven Loughner’s mental state can be improved for him to stand trial.

He has plead not guilty to 49 charges for firing into a crowd of people in Tucson that included Congresswoman Gabrielle Giffords.
