A bathtub drowning death of a Kansas City toddler has been ruled accidental, even though a 5-year-old girl told police she held the boy’s head underwater to kill him because he wouldn’t go to sleep.
A 16-year-old mentally disabled girl was the oldest person home at the time of the death.
The ruling says the 5-year-old’s age prevented her from being able to form the intent to kill — a necessary component of a homicidal act.
