Sex offender raped while in custody, sues state and wins

February 16, 2011 By Jessica Machetta

A convicted sex offender who says he was raped by his roommate at the state facility for sex offenders in Farmington has won a $25,000 federal lawsuit against the mental health department. The department runs the facility. Timothy Nelson charged facility staff showed “deliberate indifference” to his psychological and medical needs after he was raped. Nelson was sent to the center after serving four years in prison from Barry County for raping an underage girl, causing her pregnancy.
