A federal judge says the Blunt Administration and the Legislature were arbitrary in the cuts they made to some parts of the Medicaid program two years ago.

Judge Dean Whipple has ordered the state to reinstate Medicaid coverage for durable medical equipment and has given the state a month to file a new plan for coverage.

The judge says the state has not shown it used a reasonable standard to decide what durable medical equipment should be covered and what equipment should not be covered, resulting in an unreasonable denial of benefits to disabled Missourians. He says coverage must be restored for 30 days and has ordered the state to come up with a new coverage plan by the end of that period.
