An agreement has been reached to end the legal dispute over allegations the board of the Missouri Higher Education Loan Authority violated the Sunshine Law in January of this year when it met to approve the sale of $350-Million of MOHELA assets to pay for buildings and other capital improvements on college and university campuses. Under the agreement, MOHELA and the individual defendants – past and present – agree they committed violations of the Sunshine law between January 20th and January 31st of this year. The individual defendants in the lawsuit Attorney General Jay Nixon filed in February include former MOHELA Board members Karen Luebbert, Marilyn Bush, James Ricks, Gregory Fitch, Kathryn Swan and James Mauze as well as current member John Greer. Each will pay $1,000. Nixon points out this deal involves only the Sunshine Law violations and is not linked, in any way, to concerns related to the actual plan to sell MOHELA assets.
