Governor Blunt has signed the eminent domain bill into law, restricting the methods by which private property can be seized for economic development. Blunt says the bill flatly rejects the US Supreme Court ruling of Kelo versus New London that allows eminent domain to be used to clear land for developments that generate higher tax revenues. The law prohibits the use of eminent domain soely for economic development purposes. Government would not be able to declare farmland blighted so it could be condemned to make way for developments. It would require a higher price be paid for property seized. Factors in addition to fair market value would have to be incorporated in the price paid. Eminent domain procedures would have to be fully explained. Blunt signed the bill during a ceremony in his Capitol office. He is holding signing ceremonies in LaPlata, St. Joseph, Webb City and Fair Grove. The bill (HB1944) goes into effect August 28th.
