The Missouri Court of Appeals has ordered a new trial for a Kansas City man convicted in the 1997 killing of a woman whose dismembered body was found in the Missouri River. In 2001, Henry Daniels was convicted of second-degree murder in the death of Linda Smith – whom he had once dated – and was sentenced to 25 years behind bars. The Court of Appeals has ruled Daniels’ right to a fair trial was violated because the judge in the murder trial allowed damaging testimony without a pre-trial hearing to determine the scientific evidence of that testimony.
