Death Row Inmate Running Out of Appeals

A federal appeals court has rejected the appeal of prison inmate Marlin Gray, who is scheduled for execution tonight. He’s already been to the U.S. Supreme Court once and has lost. The appeals court in St. Louis has refused to delay the case so another appeal can be filed. Gray already has a new appeal before the Supreme Court in Washington. Gray has met with the State Board of Probation and Parole. It’s recommendation to the Governor won’t be made public until after the Governor decides whether to follow it and that decision won’t be made until all other appeals are exhausted.
