A judge in Jefferson City has ruled the State Attorney General’s Office is within its right to proceed with its suit against the State Department of Natural Resources over DNR’s plan to give the railroad bridge at Boonville to the Union Pacific Railroad. The Department of Natural Resources had attempted to have the Attorney General’s Office disqualified because of an alleged conflict of interest. Scott Holste with the Attorney General’s Office says the actual matter involving the right of DNR to give away the bridge is still way off in the distance. In issuing his ruling, Cole County Circuit Judge Byron Kinder agreed to allow DNR to depose an Assistant Attorney General the Department says has advised DNR in the past on this same issue.
