Nixon Asks Supreme Court to Reconsider Beine Ruling

Attorney General Jay Nixon has formally asked the State Supreme Court to reconsider its decision to overturn the conviction of former Catholic priest and former St. Louis elementary school counselor James Beine on charges he exposed himself to students. Last month, in a 4-3 decision, the Supreme Court ruled the portion of the sexual misconduct law under which Beine was convicted was unconstitutional. Nixon says he believes the Court erred in its ruling. He further asks the Court to either affirm Beine’s conviction or remand the case for retrial. Beine, who is also known as Mar James, has been ordered released from prison on bond, but his attorney says James will remain behind bars for his own safety.
