Supreme Court To Decide On Drunk Driving Charge Against Sleeping Man

The State Supreme Court is deciding whether a person can be considered to be driving while intoxicated when he’s asleep in his car. The case involves Eldon resident Steven Cox, who was arrested when a policeman found him behind the wheel of his car, which was running, but parked. Cox’s lawyer says the policeman had no grounds to arrest Cox because there was no evidence he was doing anything but sleeping. Two lower courts have overturned the Revenue Department’s adminsitrative suspension of his drivers license.
