The challenge to the state’s power to force sales taxes to be collected on funerals is headed to the State Supreme Court. While the challenge works its way through the system, funeral homes keep collecting the tax. State law says they must. The President of the Missouri Funeral Directors Assocition, Jeffrey Stygar, says a ruling that the tax is illegal will mean funeral homes will have to pay money back for about three years of funerals. But, it’s more complicated than writing a check. No date has been set for the state supreme court to hear the case. The State Revenue Department is appealing a judge’s ruling that the funeral sales tax is illegal.
