Attorney General Jay Nixon has responded to Governor Bob Holden’s questions regarding the make-up of the Senate and House redistricting commissions. Problems arose when State Representative Mark Richardson of Poplar Bluff withdrew his name from consideration when it was learned there might be issues with his serving in the Legislature and on a state commission at the same time. Governor Holden appointed him, anyway, creating uncertainty. The issue was sent to the Attorney General, whose response tells the Governor is a vacancy and it must be filled. But the Governor does not have to accept nominations from the Republican Party to fill the vacancy. Finally, the Attorney General recommends that the Governor consult with the Senate before filling the vacancy.
