Misdemeanor drug charges have been thrown out by a northwest Missouri judge because the highway Patrol Crime Lab had not process evidence for six months.
The DeKalb County prosecutor says the State Highway Patrol has told him the results would not be available for another month, at least. Suspect Nicholas Garcia has already been in jail for six months waiting for court action.
 The judge says it’s not fair to continue holding Garcia.
