The State Supreme Court has heard a third appeal of the death sentence given to Ernest Johnson, who was convicted of beating three Columbia convenience store employees to death with a hammer in 1994.

The Court has overturned his death sentence twice before.  Johnson’s lawyer says Johnson is mentally retarded and cannot be sentenced to death under Missouri law.
