Questions arise as to whether there really is a problem, but the House approves a resolution that would prohibit the courts from imposing a tax increase.
Sponsor Jane Cunningham (R-Chesterfield) has promoted her measure, HCS HJR 1 , by referring to a case in which a federal judge imposed a tax increase to settle the Kansas City school desegregation case. Representative Paul LeVota (D-Independence) presses Cunningham, pointing out she hasn’t referred to any state cases. Cunningham acknowledges there hasn’t been a case of a state judge imposing a tax, though she contends it has been threatened. She tells LeVota that her measure would be a preventative measure. Cunningham claims other state courts have followed the lead of the federal court.
The resolution now moves to the Senate. The resolution would amend the state constitution. If the legislature approves it, it will go to a vote of the people.
