The State Supreme Court has ruled the tobacco tax initiative should appear on the November ballot. In a unanimous decision, the judges affirmed Cole County Circuit Judge Tom Brown’s ruling that the measure should be placed on the ballot. The initiative had initially been rejected by the Secretary of State due to a lack of valid petition signatures from the 5th Congressional District in Kansas City. Additional signatures were found, supporters of the initiative – the Committee for a Healthy Future – launched legal action, and won in court. Opponents – Missourians Against Tax Abuse – then appealed the lower court ruling to the State Supreme Court, which has now affirmed the lower court ruling. In addition, the Supreme Court has ordered that any motion for a rehearing of this case must be filed on or before 4 pm this Friday.
