A state appeals court has thrown out a $67,000 judgment won by a woman to tripped over a carpet at a garage sale in Independence. The appeals court says the judge in the case gave erroneous jury instructions. The lawyer for Jeanine McLaughlin says she’ll ask for a new trial. McLaughlin bought a big rag doll at the sale that was so big she could not see the rolled-up carpet in front of her as she walked out. Her tumble broke both of her shoulders. She says she ran up more than $100,000 in medical bills.
