A State Highway Patrol technician reviewing DNA evidence used to put a man under a death sentence 13 years ago says he cannot find any DNA that links him to the crime. Inmate Brian Kinder and his attorney say the DNA evidence used in his trial was altered or poorly processed. A special judge is considering where the case should go from here. Assistant Attorney General Debbie Daniel is not ready to say the new evidence weakens the case for supporting the original conviction. Kinder’s lawyer strongly disagrees. He wants more sophisticated testing done on some evidence the Highway Patrol could not fully check. He believes that evidence also will show there’s nothing to tie Kinder to the death of a distant cousin in Crystal City in 1990.
