Former state prison inmate Daryl Davis has been cleared by a federal court to sue state prison employees who kept him in prison 57 days after a judge ordered him freed. Davis, who is from Overland, was convicted of stealing from a charity in 1997. His conviction was overturned on appeal, but a new trial was ordered. Davis pleaded no contest and was sentenced to time served. The judge ordered his immediate release. But the federal appeals court says St. Louis County officials sent him back to the prison in Fulton and did not send a copy of his new sentence with him. Davis was even sent to the Farmington prison for a behavior modification program after he kept insisting he should be freed.
