A wrongful death lawsuit filed by the family of a man who died at Claywest nursing home in St. Charles in 1999 has been settled for $335,000. The suit claimed 60-year-old Donald Mallory died after losing 39 pounds in 42 days at the home. It was filed by Mallory’s son who claimed his father was malnourished and dehydrated and eventually died because of a lack of proper care. The settlement came a day after the president of the former nursing home operator was sentenced to one year in jail for failing to report elderly abuse in another case at Claywest.
